Pre-Filing Bankruptcy Counseling
CCCSDV provides pre-filing Bankruptcy counseling in person or over the phone. At this time, we do not provide online counseling that fulfills the requirement of Pre-Filing Bankruptcy counseling.
CCCSDV is approved to issue certificates evidencing completion of a prefiling counseling session in compliance with the Bankruptcy Code. Approval does not endorse or assure the quality of a Provider's services.
Upon completion of the bankruptcy counseling session:
- You will be issued a Pre-filing Counseling Certificate. This document proves the debtor received the required counseling under the new law of 2005
- You will need to obtain this counseling certificate within 180 days prior to filing a petition for bankruptcy and provide it to the court. Should you decide to file your petition more than 180 days after obtaining a certificate, you must complete a new counseling session and obtain a new certificate
Consumers seeking Pre-filing Bankruptcy Counseling required under The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCP) will be charged a fee of $50. Fee reduction or waiver to those consumers demonstrating an inability to pay the requested fee, e.g. those living below the poverty line, is standard practice. Services are provided without regard to ability to pay.
